Definitions

• "Appxcel" / "we" / "us" refers to Sivario Buchanan, trading as Appxcel, a sole proprietorship operating in South Africa, in engineering partnership with BuildsByBuchanan.
• "User" / "you" refers to any individual or business that creates an account, subscribes to, or otherwise uses an Appxcel product.
• "Products" refers to Monthlys, and any other application published under the Appxcel brand.
• "Subscription" refers to any paid plan billed on a recurring or once-off basis through Paystack.

Our Products

Appxcel operates as a software incubation studio publishing standalone digital products, currently including:

• Monthlys — a privacy-focused period and ovulation tracking application.

This website — appxcel.vercel.app — is written in Kittine, the language created by Sivario Buchanan and BuildsByBuchanan. Each product may have its own onboarding flow, pricing, and feature set, but all are bound by these Terms unless a product publishes supplementary terms of its own.

Accounts

You must provide accurate information when creating an account and keep your login credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately at support@appxcel.co.za if you suspect unauthorised access.

You must be at least 18 years old, or have the consent of a parent or legal guardian, to create an account.

Subscriptions & Billing

All payments are processed securely by Paystack. Appxcel does not store your card or banking details — these are held and processed directly by Paystack under its own security standards and privacy policy.

Prices are listed in South African Rand (ZAR) unless stated otherwise. Recurring subscriptions renew automatically at the end of each billing cycle until cancelled. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period and no partial-period refund is issued for time already paid for, except as set out in Section 5.

We reserve the right to change subscription pricing with at least 30 days' notice to active subscribers before the change takes effect on their next billing cycle.

Refunds & Cancellations

See our full Refund Policy for details. In summary:

• Once-off purchases may be refunded within 7 days of purchase if the product has not been substantively used.
• Recurring subscriptions may be cancelled at any time; the cancellation stops future billing but does not refund the current paid period.
• Refunds, where approved, are issued back to the original Paystack payment method within 10 business days.

Acceptable Use

You agree not to: reverse-engineer or resell access to any Product; use a Product to store or transmit unlawful content; attempt to circumvent usage limits, security controls, or billing; or use automated means to scrape or overload our infrastructure.

We may suspend or terminate accounts that violate this section, with or without notice, depending on severity.

Intellectual Property

Appxcel retains all rights, title, and interest in the Products, including all underlying source code, design, and trademarks. Subscribing to a Product grants you a limited, non-exclusive, non-transferable licence to use it for its intended purpose — no ownership rights are transferred.

Any content you create within a Product (notes, entries, logs, or project data) remains yours. We claim no ownership over user-generated content.

Data & Privacy

Our collection and use of personal information is governed by our Privacy Policy and, for South African users, our POPIA Compliance Notice. By using a Product, you agree to those policies.

Availability & Support

We aim for high availability across all Products but do not guarantee uninterrupted or error-free operation. Planned maintenance will be communicated in advance where practical. Support requests can be sent to support@appxcel.co.za and are handled on a best-effort basis.

Limitation of Liability

Appxcel is not liable for indirect, incidental, or consequential damages, loss of data, or loss of profits arising from use of any Product, except where such exclusion is not permitted by South African law.

Termination

You may stop using a Product and delete your account at any time. We may suspend or terminate your access for breach of these Terms, non-payment, or extended inactivity, with reasonable notice where practical.

Dispute Resolution

If a dispute arises, please contact us first at support@appxcel.co.za so we can attempt to resolve it informally. If unresolved within 21 days, either party may pursue formal proceedings as set out in Section 13.

Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any dispute that proceeds to formal legal action is subject to the exclusive jurisdiction of the South African courts.

Changes to These Terms

We may update these Terms from time to time. The current version is always available at this URL. Continued use of a Product after an update constitutes acceptance of the revised Terms.
